I have seen some companies who developed fluid like stuff, perhaps someone has to dig deeper into the specific patent and get the exact point, what is patented. Perhaps only the stable part is patented, but as Jos Stam is mentioned as one of the two inventors, it could be difficult. A lot of other fluid research is based on his stable fluid research (presented at SIGGRAPH 99 Conference Proceedings)
