Back The EULA for my plugins specify that people who buy it aren't to give it out either, but from a legal standpoint, if I find someone who has given it out and is not a customer, I can hammer them pretty hard in the courts, no matter what the EULA says. Simple as that, pick it apart or try to parse it as much as you want, but it's illegal to distribute software to which you have no distribution rights, unless it's explicitly stated. The fact that someone downloads the software and does not install it does NOT give them the right to copy and distribute that software to those who have not gone to the company for their own copy, regardless of the EULA which states that customers can't distribute it.
The whole reason why the rules in the EULA apply to customers is because it's already a law outside of the EULA, and some applications do allow for some distribution of the application, so that needs to be specified to the customers to show them what they can and cannot do with the software. If you aren't a customer, then you fall under the rule of law, and unless the license of the software states that it can be freely distributed(which it's obvious that it can't or else you wouldn't put the effort into sea-lawyer interpretations of the EULA), you are subject to that law.
